Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Kizuna Collective LLC (“Kizuna Collective”, “we”, “us”), the maker of The Toy Shelf: Games and Puzzles (“The Toy Shelf” or the “App”). By downloading or using The Toy Shelf, you agree to these Terms. If you don’t agree, please don’t use the App.

If you are under the age of majority where you live, a parent or guardian should review these Terms with you and agrees to them on your behalf, including for any purchase.

2. What The Toy Shelf is

The Toy Shelf is a collection of casual games, puzzles, drawing toys, interactive toys and calming visuals for fun and relaxation. It works without an account and without an internet connection, except when making or restoring a purchase.

3. Free trial, free plan and the full unlock

• Free trial. For your first 7 days, every toy is open. There is nothing to sign up for and no payment details are needed. The trial does not turn into a paid purchase on its own.
• Free plan. After the trial, you choose three toys to keep free for as long as you use the App, and you can swap one of them once a week.
• Full unlock. A single one-time in-app purchase unlocks every toy in the App. It is not a subscription: it never renews and there is nothing to cancel. The price is shown in the App Store or Google Play in your local currency before you buy.

Because trial and plan details are stored on your device, deleting and reinstalling the App may reset them. The full unlock is tied to your Apple or Google account, not your device: use Restore purchase in Settings to get it back at no extra cost on any device signed in to the same account.

The full unlock covers the toys in the App and any we add later in updates, for as long as we offer the App. We may add, change or retire individual toys over time.

4. Payments and refunds

Purchases are processed by Apple or Google, under their terms, and charged to your Apple ID or Google Play account. We never see your payment details. Refunds are handled by the store you bought from, under its policies: Apple or Google Play. Nothing in these Terms limits any refund rights you have under the law where you live.

5. Your license to use The Toy Shelf

We give you a personal, non-exclusive, non-transferable, revocable license to use The Toy Shelf on devices you own or control, for your own non-commercial use, as allowed by the rules of the store you downloaded it from. You agree not to:

• copy, modify, resell, rent or redistribute the App or its content,
• reverse engineer or decompile the App, except where the law expressly allows it,
• get around the trial, the free plan or the purchase system,
• use the App in any way that breaks the law.

6. Ownership

The Toy Shelf, including its design, artwork, sounds, text and code, belongs to Kizuna Collective LLC or its licensors and is protected by copyright and other laws. “The Toy Shelf” and “Kizuna Collective” are our names and marks. Some parts of the App use open-source software and fonts under their own licenses (for example, Iconoir icons under the MIT License and fonts under the SIL Open Font License), and those licenses apply to those parts.

7. Privacy

The Toy Shelf collects no personal information. Our Privacy Policy explains what stays on your device and the one purchase check the App makes.

8. Health and safety

Some toys use moving patterns, flashing colors and vibration. If you or your child have photosensitive epilepsy or are sensitive to motion or flashing lights, please take care and stop playing if you feel unwell. Some toys respond to tilting the phone, so please be mindful of your surroundings. The Toy Shelf is for entertainment and relaxation and is not a medical or therapeutic product.

9. Updates and availability

We may update the App from time to time to fix problems, improve it or add toys. Some updates may be required to keep using it. We can’t promise the App will always be available, and we may stop offering it at some point.

10. Disclaimer

We work hard to make every toy work well, but The Toy Shelf is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise the App will be error-free or uninterrupted, or that saved scores or progress will never be lost.

11. Limitation of liability

To the fullest extent allowed by law, Kizuna Collective LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from your use of or inability to use The Toy Shelf. Our total liability for any claim relating to the App is limited to the amount you paid for it, if anything. Some places don’t allow these limits, so they may not all apply to you.

12. Ending these Terms

You can stop using The Toy Shelf at any time by deleting it. If you break these Terms, your license to use the App ends. Sections 6, 10, 11 and 13 continue to apply after these Terms end.

13. Governing law

These Terms are governed by the laws of the State of Hawaiʻi, USA, without regard to its conflict-of-law rules, except where the law where you live requires otherwise. If any part of these Terms can’t be enforced, the rest still applies.

14. Apple App Store terms

If you downloaded The Toy Shelf from Apple’s App Store, you also acknowledge that:

• these Terms are between you and Kizuna Collective LLC only, not Apple, and we, not Apple, are responsible for the App and its content;
• your use of the App must also follow the Usage Rules in Apple’s Media Services Terms and Conditions, and Apple’s Standard Licensed Application End User License Agreement applies alongside these Terms;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent allowed by law Apple has no other warranty obligation for the App;
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims;
• if a third party claims the App infringes their intellectual property, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim;
• you confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Google Play terms

If you downloaded The Toy Shelf from Google Play, your use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the date at the top of this page. If you keep using The Toy Shelf after a change, you accept the updated Terms.
